The suit, which was filed in Tokyo District Court, alleges that Toshiba has violated one of its Japanese patents, specifically to techniques for providing interactive program guides (IPGs) and for controlling recordings from IPGs. Gemstar-TV Guide, which publishes TV Guide magazine, had been in negotiations to license Toshiba as a commercial partner for sales of consumer electronic devices that use IPGs.

“While we have always worked cooperatively with all industry participants in the Japan market, we ultimately have a responsibility to our shareholders, employees, licenses and other stakeholders to protect the value of our intellectual property,”  Japan’s Gemstar-TV Guide Multimedia president Akitaka Nishimura said in a statement. A Toshiba spokesperson could not immediately be reached for comment.

Gemstar-TV Guide has an extensive portfolio of nearly 200 patents and pending applications directed to IPGs in Japan, according to the statement.
